It can take a little while for a licensed image to get from the art department to the bottling plant to the consumer. Most businesses do what is called net 30 or net 60. Some will even go so far as net 90. What this means is that the business or retailer gets the product upfront then pays later. This is usually done so the business has a chance to turn a profit before making payment. With all the products in the store it would be impossible to pay all the vendors up front. Some businesses demand a guarantee that the product will be purchased back if it does not sell. This is not a good thing so we want to use the best images possible on the label to help guarantee sales. When the purchaser makes payment that money first goes to the bottler or distributor depending on the arrangements made beforehand. Usually the bottler. The bottler then pays the distributor then the distributor "Model on a Bottle" pays the Photographers and Models there royalty payments and cash bonus's where applicable the first Friday of the month following or sooner if possible. All data will be posted online and available.

Most photographers and Models have a personal standard rate which can be by the half day or day. While the majority of the images on the label of Model on a Bottle will be images licensed from a Photographer and Models private collection for label use, there is always the option to hire for special projects. The rules are that no advertiser may advertise directly on the label front as that space is reserved for Models and Photographers images, Musicians, Athletes and celebrity’s. So long as the Model is on the front label and has there unique ID showing that Model may wear a designers outfit or accessory, car or almost anything approved within reason and the advertiser may advertise on the side label and associate with what the model is promoting personally for the advertiser. The reason for keeping Models and Photographers images and other Artists on the front label is to support, sponsor and promote the artistic community. Distribution of funds to Photographers and Models on Label. If a Photographer is the sole copyright owner and Licensor then the total amount is given to the Photographer by Model on a Bottle once receiving from the advertiser less processing fees which cover the cost of credit card processing or postage and handling. Example: Photographer has ¨ ¨ ¨ s and sole copyright so photographer receives $150.00 upfront plus 3% royalty of all sales that have that photographers image plus 100% of any cash bonus’s for being popular. If the Model is the sole copyright owner and Licensor then the total amount is given to the Model by Model on a Bottle once receiving from the advertiser less processing fees which cover the cost of credit card processing or postage and handling. Example Model has ¨ ¨ ¨ ¨ s and sole copyright so Model negotiates with advertiser for $200.00 for image and receives that amount upfront plus 3% royalty on all sales with Models image and 100% of cash bonus’s for being popular. Another example. Photographer and Model have shared copyright. 50-50 of photo. Photographer has ¨ ¨ ¨ s and Model has ¨ ¨ s. The value of the promotional image is based on experience and popularity, not copyright. The royalty is based on copyright ownership. So the Photographer’s value is $150.00 and the Models is $100.00. The Photographer would received 1.5% Royalty and the Model would receive 1.5% Royalty. Each would receive 50% of the Cash Bonus’s. As an advertiser you need only know what the diamonds next to the Models or Photographers picture to make a bid on that photograph. A photographer or model has the right to allow promotional image use of there photograph for each 100,000 agreed to copies with a business sponsor. Once that image has left the bottling plant for it’s last 100,000th bottle then that image is up for reuse by the business sponsor or another business sponsor. If a business wants exclusivity for that particular photo or wants to negotiate for an extension past 100,000 copies a bid or offer to the copyright owner should be made in due time.
Off the chart: A particularly well known, famous, highly sought after photographer and or model may have there own promotional image value not on this chart. If you see "Off the Chart' on that Model or Photographers page you may submit by private bid your offer for use of there promotional image next to your advertisement. *** Advertisers may have an associated link on the Model or Photographers page and that link may remain for the life of the bottled water ad so long as the linking URL is maintained by the advertiser and the advertiser continues to pay for there domain name. In the event the advertiser forgets to pay for there domain name and it is bought out by a pornography or other type site the linking URL will be removed. Because this happens so frequently no URL’s will be allowed on the bottled water as Minors will also likely be drinking the water and saving labels and all it takes is one person to forget and the resulting lawsuit from parents would ruin everyone’s best source of advertising. |
